Just my quick 2c as the one making the spin-off that's community driven/shaped in the first place: think overall the primaries/secondaries feature will be able to cover pretty much any needs of assuming control and whatnot of nations for RP.
So perhaps the question isn't what's allowed and what's not with vacant nations - but more of what primaries/secondaries means?
Overall, I think the new control scheme and its inherent flexibility (since it lacks mechanics like classic) will generate opportunities down the road, especially as legacy will mature. And the community's use of it, of course (provided it doesn't fail completely).
All in all it'll be about empowering RPers and amplifying their RP, anyway.
