President Anong Lifts State of Emergency, Issues 'Special Security Decrees' Ahead of New Dissolution Order Effort
President Anong reforms security structure in the east to clear way for future dissolution order, early elections

Udon Nakhon – Seeking to work around the Supreme Court's stay of her previous dissolution order for the National Assembly, President Anong has lifted the sweeping state of emergency that had been imposed across the eastern provinces since 5640. In its place, the President has issued dozens of "special security decrees" covering many of the same areas that were previously under emergency rule at the district, rather than provincial, level.

The move has been widely interpreted as an attempt to remove the legal justification cited by the Supreme Court when it halted the President’s earlier dissolution order. In its ruling last month, the Court argued that dissolving the National Assembly while provinces were under emergency administration could undermine the fairness and logistical viability of national elections. Thus, by rescinding the national-level emergency designation and replacing it with localized security orders, the President’s office appears to be attempting to thread a narrow legal path that preserves order and security in the east while removing the constitutional obstacle identified by the Court.

Under the new decrees, district administrations and security commanders retain extensive powers to restrict public gatherings, impose curfews, request military support, and authorize preventative detention in designated districts experiencing unrest. However, the measures are now technically separated from the national emergency framework, instead operating under provisions of the Republic’s Special Security Administration Act, in tandem with directives from the President.

Presidential spokesperson Darin Suthichai defended the decision during a press briefing in Udon Nakhon, stating that the government had acted “in full respect of the Court’s concerns while continuing to ensure public safety.”

“We have complied with the letter of the Court’s ruling,” Darin said. “The state of emergency has been lifted. At the same time, the government will never abandon communities that are still experiencing challenges. These targeted security decrees allow us to maintain stability while restoring the constitutional conditions necessary for democratic renewal.”

During last year’s presidential campaign, Anong repeatedly promised to dissolve the National Assembly and call fresh elections. Her landslide victory in the presidential election dramatically strengthened her mandate to achieve these aims, but the Assembly and the judiciary have thus far refused to cooperate with her agenda since she took office. Government-aligned parties have accused the President of attempting to engineer a constitutional crisis in order to force early elections that could further consolidate her ascendant political coalition.

“The President is looking to override the Court’s authority,” said newly-appointed United Conservative Front (UCF) Leader Pradit Chankasem. “Changing the technical wording of these emergency measures does not alter the reality on the ground that large parts of the country remain insecure and under emergency administration.”

The President's allies, for their part, have argued that the Court’s intervention in issuing the original stay constituted a significant and unwarranted intrusion into executive authority.

“The voters elected President Anong with a clear mandate, centred around the people's demand for fresh elections to the National Assembly” said National Assembly member Niran Worasak (JP). “What we have been seeing ever since is the old political establishment using procedural tools to prevent the people's mandate from being implemented.”

Legal scholars remain divided over whether the Court will accept the President’s revised approach. Some constitutional analysts believe the district-level decrees could satisfy the Court’s concerns, as the emergency powers are no longer applied nationwide and therefore may not obstruct the conduct of elections. Others argue that the judges may view the move as a purely cosmetic or semantic change designed to circumvent the intent of their ruling.

“If the Court concludes that these decrees are functionally identical to the conditions under the previous emergency framework that it found made early elections unviable, it could intervene again,” said Professor Chayut Rattanasin of the University of Khattaya’s Faculty of Law. “At that point, the confrontation between the executive and the judiciary would escalate significantly.”

Moreover, the move has raised concerns among security analysts about the shift from a vertically integrated command to multiple localized command nodes with partial autonomy. Specifically, critics note the risk of disparities between districts regarding public restrictions (such as curfews) as well as operational clarity and a shared strategy across jurisdictions. Strong Nation Party (SNP) Interior critic, retired General Chatchalerm Sawasdipon, has accused the President of prioritizing "politics over the people's security."

Opponents to the President's agenda have vowed to challenge the legality and constitutionality of her unilateral reform to South Dovani's security apparatus, and to challenge any future dissolution orders in court. Meanwhile, sources close to the President's office suggest that the next dissolution order is actively being drafted by the President and her legal advisors.
