TITLE III JUDICIAL PROCESS

Section 1-  Police Powers of the State
III.1.a  Policy on the organization of police/law enforcement-  There is a national police department, funded by the government.

III.1.b  The weapons used by police forces-  Police officers may only carry non-lethal weapons.

III.1.c  Government's policy towards the powers of the police-  The police may arrest crime suspects.

III.1.d  The government's policy towards police presence-  The police do not actively patrol public property.

III.1.e  Police searches-  The police cannot search a person or their property without their consent unless the police have obtained a warrant from a court.

III.1.a  The use of torture for obtaining information-  Torture is never allowed.



Section 2-  Administration and Juries
III.2.a  The government's position towards the administration of law-  There are Duchy courts, but decisions of regional courts may be appealed to national courts.

III.2.b  Policy on the appointment of judges/magistrates-  Judges/Magistrates at the National Level are appointed by the Ministry of Justice. Judges/Magistrates at the Duchy Level are appointed by the Duke/Duchess.

III.2.c  The right to appeal against a judgement rendered by a court-  Every person has the right to appeal against a judgement that was found by an independent appeal board, to be "a miscarriage of justice", and to have it reviewed by a higher court.

III.2.d  The right to trial by jury (if there are courts)-  Individuals accused of any crime have the right to trial by jury.

III.2.e  Jury selection (if trial by jury is allowed)-  Jurors are randomly selected from the population.

III.2.f  Mandatory jury duty (if trial by jury is allowed)-  All adult citizens are required to serve on a jury when called or obtain a formal exemption.

III.2.g  Policy on bail for defendants accused of crimes-  Bail can only be set for serious crimes and can be in the form of money or other collateral.

III.2.h  Government provision of legal aid to the accused-  Legal representation for defendants in criminal trials is paid for by the state.

III.2.i  Parliamentary privilege-  Members of the legislature are not exempt from any civil or criminal liability for their speech or actions during their term of office.



Section 3-  Sentencing
III.3.a  Policy on mandatory minimums-  There are no mandatory minimums

III.3.b  Legality of judicial physical punishment-  All forms of physical punishment are illegal.

III.3.c  The terms of extradition-  The law bars the government from extraditing anyone who is a citizen of the state.

III.3.d  The government's position towards the use of forensic DNA databases-  Only DNA from persons convicted of crime is recorded.

III.3.e  Government policy with respect to the death penalty-  The death penalty is illegal and is never to be applied.

III.3.f  Public executions-  The death penalty is outlawed in Kalistan.

III.3.g  Prison policy concerning prisoner labor-  Prisoners can do certain jobs in prison, voluntarily, for a small wage.

III.3.h  Education in prisons-  An education plan for prisoners is provided to improve rehabilitation.



Section 4-  Tort and Civil Regulations
III.4.a  Slander laws-  Individuals may sue over malicious falsehoods spoken about them.

III.4.b  Application of libel and slander laws-  Libel and slander laws apply to and may be applied by all individuals.

III.4.c  Malpractice suits-  Malpractice suits may be brought against doctors.

III.4.d  Tort reform on non-civil lawsuits-  There is a cap on monetary damages awarded to patients in lawsuits.
